WEDDING PHOTOGRAPHY CONTRACT
Please read these terms carefully, and sign digitally to indicate your agreement.
Booking Fee/Deposit
A deposit of £200 is due upon the completion of this booking form, which will be subtracted from your final balance. This deposit is non-refundable. The remaining balance for your photography will be due one calendar month before your wedding date. No photography will be fulfilled without your payment in full.
Entire Agreement
This is a contract for photography services to be provided by Dark Peak Photography and/or individuals subcontracted to do work for Dark Peak Photography. It contains the entire understanding between the Clients and the Photographer.
Confirmation
A completed copy of this ‘Wedding Booking Form’ and payment of the booking fee are required to confirm the stated wedding services from the Photographer.
Co-operation
The Photographer will endeavour to take photographs of as many guests as possible, which may be limited by guests’ cooperation in having their photo taken. The Photographer cannot be held responsible for lack of photographs or poor-quality photographs if guests are interfering with the photographer’s work. The Client agrees to give sufficient warning of key events at the wedding wherever possible, in order to give the Photographer time to prepare (for example: the throwing of confetti, cutting of the cake, etc.).
Copyright & Model Release
Images will be provided at full resolution and free of watermarks. The photographer shall maintain the copyright of all photographs. The Photographer grants the Client permission to make copies of the images for personal use by the Client and the Client’s family and friends. Sale, publication, or any other commercial use is specifically prohibited without the prior written consent of the Photographer. The Photographer reserves the right to use the images for editorial and advertising purposes, unless the Client expresses a wish for photos to remain private.
Limit of Liability
If the Photographer becomes too ill or becomes injured and cannot supply the wedding services specified above, the Photographer will try to book a replacement wedding photographer. If a replacement photographer cannot be found, then liability is limited to a refund of any payments received. The Photographer has working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in and beyond our control. In these circumstances, liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
Cancellation Policy:
Cancellation by Client: a. If the Client wishes to cancel the wedding photography services, written notice must be provided to the Photographer as soon as possible. b. The following cancellation fees will apply based on the time of cancellation:
More than 3 months before the wedding date: The Client will be entitled to a refund of any monies paid, except for the non-refundable deposit.
1 to 3 months before the wedding date: 50% of the total agreed-upon fee.
Less than 1 month before the wedding date: 75% of the total agreed-upon fee. c. Any payments made prior to the cancellation will be credited toward the cancellation fee as specified above. If the total payments exceed the cancellation fee, the remaining balance will be refunded to the Client.
2. Cancellation by Photographer: a. The Photographer reserves the right to cancel the services if, due to unforeseen circumstances (such as illness, injury, or other emergencies), the Photographer is unable to fulfil the terms of the contract. b. In the event of a cancellation by the Photographer, a full refund of all payments made by the Client will be provided. The Photographer will also make reasonable efforts to assist in finding a replacement photographer, if requested by the Client.
3. Force Majeure: a. In the event of a Force Majeure (such as a natural disaster, government restrictions, or other uncontrollable events), both parties agree to work together in good faith to either reschedule the event or mutually cancel the contract. Refunds will be considered on a case-by-case basis.
